Terms and Conditions
Welcome to Dear Dulcie. By using our website and services or accepting an event quote, you agree to the following terms and conditions. Please read them carefully.
ONLINE ORDERS
All online orders must be paid in full at the time of checkout. Prices are in AUD and orders are not confirmed until payment has been received.
QUOTES
All quotes are valid for a total of 30 days. To confirm your quote and secure your date, we require an initial non-refundable 50% payment of the estimated total and approval of these terms and conditions.
It is your responsibility to review all event details that are provided in a quote to ensure that both yourself and Dear Dulcie have the correct information, including the date, wedding venue, and quantities of items to be delivered.
BOOKING CONFIRMATION
Your booking is confirmed once a 50% non-refundable deposit of the estimated total is paid. This deposit secures your event date and covers work completed up to that point. As we are unable to accept another event on your date once booked, the deposit is non-refundable. The deposit will be deducted from your final balance.
PAYMENT TERMS
The remaining balance for your event order is due 30 days before your event date. Full payment must be received before delivery or collection. Payment can be made by direct deposit.
Refunds & Returns – Online Flower Products
All online bouquets are perishable and made to order. We do not offer refunds for change of mind. If your order is incorrect, damaged, or of unacceptable quality, please contact us within 24 hours of delivery with a photo, and we will assess a replacement, credit, or refund in line with Australian Consumer Law.
CHANGES TO YOUR QUOTE
By accepting a quote from Dear Dulcie, you agree to the listed items and the total estimated value. Changes must be requested at least 30 days before your event date. The final total cannot be reduced by more than 10%. All changes must be submitted in writing to deardulcie.info@gmail.com.
Event Cancellations, Reschedules & Location Changes
All cancellations must be made in writing to deardulcie.info@gmail.com. Events cancelled within 30 days of the event date are payable in full.
If you cancel with more than 30 days’ notice, the initial 50% deposit remains non-refundable.
Any amounts paid above the deposit will be issued as a store credit, valid for 6 months.
Any change to the event date or venue must be advised in writing. We will do our best to accommodate changes; however, availability cannot be guaranteed. If we are unavailable for the new date, the 50% deposit remains non-refundable.
If we are able to accommodate the new date or venue, your deposit will be transferred. A new quote and agreement will be issued to reflect any changes in pricing or requirements.
FLOWER AVAILABILITY AND SUBSTITUTION
Flowers are seasonal and subject to market availability. We may substitute flowers with those of equal or greater value while maintaining the overall style and colour palette. Substitutions do not qualify for refunds.
DELIVERY
Upon delivery (or collection) the client assumes all responsibility and care for your flowers and designs. Delivery of flowers purchased through our website are available within a 25km radius of Leeming. Delivery times are estimates only and may be affected by traffic, weather, or other unforeseen circumstances. It is the customers responsibility to provide accurate delivery details.
MISSED DELIVERY OR DELIVERY FAILURE
We are not responsible for failed or missed deliveries due to incorrect addresses, unavailable recipients, or inaccessible delivery locations.
PERISHABLE GOODS AND FLOWER CARE
Flowers are natural, perishable products. Flower longevity depends on care, environment and weather conditions. We are not responsible for deterioration once flowers have been delivered and accepted.
HIRED ITEMS
All hired items remain our property and are provided on a hire-only basis unless otherwise purchased. Hired items must be returned within 48 hours of the event unless otherwise agreed or Dear Dulcie assists in event pack-down. Any items that are lost, broken, damaged, or removed from the venue will be charged at full replacement cost.
PHOTOGRAPHS & VIDEO FOOTAGE
We reserve the right to photograph all finished work and use images of your wedding or event for marketing purposes. This includes, but is not limited to, social media, websites, brochures, Pinterest, advertising, magazines, and other promotional materials. Any photos provided to us by your photographer may also be used for marketing, with the photographer credited where appropriate.
SUPPLYING YOUR OWN VASES AND STRUCTURES
If you provide your own vases, arbor, or ceremony structures, it is your responsibility to ensure they are secure and safe for all weather conditions. We are not responsible for damage to client-supplied or hired items, and no refunds will be given if work cannot be completed due to unsafe or faulty materials.
WEATHER CONDITIONS
In cases of extreme weather (wind, rain, heat, or cold), safety is our priority and we follow government advice. We are not liable for any impact extreme weather has on our ability to provide services.
FORCE MAJEURE
We are not liable for failure or delay in performing services due to circumstances beyond our control, including but not limited to extreme weather, supplier shortages, natural disasters, or government restrictions.
INTELLECTUAL PROPERTY
All images, designs, text, and content on our website and social media remain the property of Dear Dulcie and may not be used without permission.
AUSTRALIAN CONSUMER LAW
Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
GOVERNING LAW
These Terms and Conditions are governed by the laws of Western Australia. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Western Australia.
